Don’t issue such certificates that can’t stand legal scrutiny: Himachal HC to medical officers

The court has asked the additional chief secretary (health) to investigate the matter and issue instructions to end the practice within four weeks. (Figurative)

The Himachal Pradesh High Court ordered state medical officials to issue certificates that are not valid in a court of law, calling such certificates “false and false.” The court noted that several medical officers issue certificates to patients or people with disabilities with a note that the certificate would not be valid for court cases or to claim compensation.

“It is time for this practice to end. Otherwise, it would give impetus to medical officials, be they government doctors or private professionals, to issue such certificates that are not judicially relevant and inadmissible, and therefore are nothing less than fabricated and false certificates that can be Misused, ”He observed a division bank of Tarlok Singh Chauhan and Jyotsna Rewal Dua while listening to a request from a Sirmaur school teacher who challenged his transfer.

The court found no merit in his petition, but during the course of the hearing, it emerged that the teacher’s disability certificate, issued by a medical director, included a note saying that the certificate would not be valid for court cases. and for claiming compensation.

The court noted that certificates with such notes are issued “day after day,” and questioned the justification for the practice.

“We are convinced that this note has been added only with the intention that the official issuing the certificate cannot be brought before the court or tribunal if it is eventually discovered that the certificate is false in whole or in part. The court cannot approve this, ”the court noted.

The court has asked the additional chief secretary (health) to investigate the matter and issue instructions to end the practice within four weeks.
